On July 21, 1936, the defendant agreed that money owed by Columbia Graphophone should be divided equally with Joseph Smilovits, Sandor Roth, and Imre Hartman so that each should receive one-fourth. In 1943 there were deposited 3 amounts to the credit of the defendant to which the plaintiff's assignors are entitled to three-fourths. The defendant shall pay each of plaintiff's assignor's one-third of this amount. The defendant shall authorize Columbia Graphophone Company hereafter to pay each of the plaintiff's assignors one-fourth of money due hereafter. Should the Lener Quartet be obligated to Musical America and Charles Kieger by reason of matters arising during the period when the defendant and the plaintiff's assignors were performing together, such debt shall be borne to the extent of three-fourths by plaintiff's assignors and one-fourth by the defendant.
